These Terms govern your use of the momentake service. By creating an account or using the platform, you agree to these Terms, including permission to use your logo and brand name for platform marketing (Section 9).
Acceptance of terms
The service is available only to users who accept these Terms and comply with applicable law. If you act on behalf of a company, you represent that you have authority to bind that entity. Minors may use the service only with consent from a parent or legal guardian.
Account
You must provide accurate registration data, keep it up to date, and protect account credentials. You are responsible for activity performed through your account. The service may require step-up authentication for critical security actions (including account erasure). You must immediately notify support of suspicious or unauthorized access.
Acceptable use
You may not publish illegal content, infringe copyright or related rights, distribute malware, bypass access controls, or overload the infrastructure. You are also responsible for having a lawful basis to process third-party personal data included in uploaded materials. We may restrict access, remove materials, or block the account for violations.
Content rights
You retain your rights in the content you upload. By uploading content to momentake, you grant us a non-exclusive license required to host, transcode, generate technical derivatives (e.g. HLS, previews), and deliver content to your clients according to your settings. You warrant that you have all rights and permissions.
Payment and subscription
Paid plans are provided under the selected plan and its limits. Storage quota is calculated based on your original uploaded files; transcoded HLS artifacts are not counted toward that quota. Payments are processed via Monobank, and auto-renewal can be disabled in Settings (Plans & Billing → Cancel subscription). After subscription end, a 14-day grace period for data retention applies; after that, data (files and galleries) are subject to deletion under the current platform policy. Refunds and disputes are handled under the payment provider rules and applicable law.
Termination
We may temporarily suspend or terminate access in case of Terms violations, non-payment, technical risk, or security requirements. You may stop using the service at any time and request deletion of your data. After subscription end, retention and deletion are handled under the current platform policy.
Disclaimer and limitation of liability
The service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation at all times, and we are not liable for indirect, incidental, or lost-profit damages. Our maximum liability is limited to the amount you actually paid for the most recent billing period, unless mandatory rules of law expressly provide otherwise.
Changes to terms and contact
We may update these Terms by publishing a new version on the site. We notify you of material changes in the product interface or by email. Continued use after the effective date means acceptance of the updated Terms. Contact: the feedback form on momentake.com.
Marketing use of your logo and brand
By registering or continuing to use the service, you allow momentake to display your logo, trademark, and studio name (as provided in your profile, gallery branding, or uploaded materials) for platform marketing purposes — including on the momentake.com homepage (partners section), in presentations, social media, and other channels promoting the service, without separate payment. You confirm you have the right to grant this permission. You may withdraw consent by contacting support; we will stop new publications where technically feasible, but materials already published may remain in third-party caches or archives for a limited time.
